§§ 72 Abs. 2 Satz 6, 7 Abs. 1 Satz 1 HG NRW a. F. erweisen sich danach als unvereinbar mit den Anforderungen des Art. 5 Abs. 3 Satz 1 GG in Verbindung mit dem Demokratieprinzip und dem Rechtsstaatsprinzip.

Hence, §§ 72 sec. 2 sentence 6, 7 sec. 1 sentence 1 HG NRW (f.v.) prove to be incompatible with the requirements set forth in Art. 5 sec. 3 sentence 1 GG in conjunction with the principle of democracy and the rule of law.
